1. About us
BesiaBIM is the trading name for software and services provided by Sebastian Maciuszko trading as SeboticAI (ABN 76 842 369 494), based in South Australia. SeboticAI is not GST-registered, so no GST is charged on our invoices. Prices on this site are listed in Australian dollars (AUD) unless stated otherwise.
In these terms, "we", "us", or "BesiaBIM" means SeboticAI, and "you" means the individual or company using our software or services.
2. Acceptance
By signing up for an account, subscribing to a catalog product, or engaging us to build a custom add-in or tool, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.
3. What we offer
BesiaBIM provides two kinds of work:
- Catalog products — off-the-shelf add-ins and tools (for hosts such as Revit, AutoCAD, DraftSight, and Inventor, plus standalone desktop and web tools) sold fromour catalog on a subscription. Sections 4–7 cover these.
- Custom builds — we design and deliver a tool tailored to your workflow under a separate written service agreement signed before work starts. Section 8 covers the general framework; the per-engagement agreement is what actually binds the parties for that build.
4. Subscriptions and billing
Catalog subscriptions are billed by Lemon Squeezy, who is the Merchant of Record for the transaction. Lemon Squeezy collects payment, issues receipts, and handles any required tax. Billing cadence (monthly or annual) and any trial period are shown on the checkout page and inside your dashboard.
If your plan includes a free trial, you can cancel before the trial ends and pay nothing. Otherwise we charge the payment method on file at the end of the trial. Card details are handled by Lemon Squeezy — we never see or store raw card data.
5. Licences
Each active subscription is licensed to the purchasing user and may be activated on up to two of that user's devices. (We may offer team plans with multiple seats in future.) Licences are non-transferable and may not be shared across companies or with contractors who are not operating directly on your behalf.
We can revoke a licence for abuse (e.g. attempting to redistribute or reverse-engineer the software) or for non-payment after a reasonable cure period. You may cancel at any time from the customer portal.
6. Refunds and cancellations (catalog products)
Cancel before the end of your trial and you pay nothing. After the trial, we do not offer pro-rated refunds for the current billing period — you keep access until the period ends and the subscription simply does not renew.
If you believe a catalog product is materially broken for your use case, email us within 14 days of your first paid charge and we will work through it with you. This is separate from your statutory rights under the Australian Consumer Law (see §11).
7. Acceptable use
Don't reverse-engineer, decompile, or attempt to extract source from BesiaBIM software. Don't strip or modify branding, version info, or copyright notices. Don't resell, sublicence, or redistribute the software to a third party. Don't use our APIs to scrape, mass-harvest, or otherwise disrupt the service for other customers.
8. Custom add-in engagements
Custom builds are governed by a separate written service agreement signed by both parties before work starts. That document sets out:
- the parties, scope, and what is explicitly not included;
- the total fee, deposit, and final-payment schedule (AUD, bank transfer);
- the delivery target, structured review rounds, and acceptance criteria;
- conditions under which a deposit is or is not refundable;
- ownership and the licence you receive over the delivered build;
- indicative pricing for future updates or additional work.
Unless we agree otherwise in writing, source code, generator logic, and the installer for a custom build remain the intellectual property of SeboticAI. You receive a non-exclusive, non-transferable licence to install and use the tool within your business, including the right to use any drawings or outputs it produces for any business purpose. We may reuse the underlying engine and patterns in future products sold to other clients — your specific data, configurations, and confidential materials remain private under §10.
9. Your responsibilities
BesiaBIM software is a productivity tool, not a quality-assurance tool. You remain responsible for visually checking every output (drawing, sheet, model change, exported file) before sending it for production, construction, fabrication, or any other downstream use. We accept no liability for production losses, material waste, rework, or downstream issues arising from an output being incorrect.
You are also responsible for holding a valid host-application licence (e.g. Revit, AutoCAD, DraftSight, Inventor) at the tier required to run the add-in on every workstation where it is installed. We do not supply third-party host licences.
10. Confidentiality
We treat as confidential any non-public business information you share with us during a custom engagement — measurement sheets, sample jobs, customer data, pricing, internal conventions. We will not share that information outside the engagement and will not reference your business publicly without your prior written consent.
We may use anonymised, non-identifying technical learnings (e.g. "working with DraftSight 2026's API") in our own product development, marketing, and documentation.
11. Limitation of liability
BesiaBIM software is provided as-is. To the maximum extent permitted by law, our total liability to you under or in connection with these terms is limited to the amount you have paid us in the 12 months immediately preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special losses (including lost profits, lost data, or business interruption) regardless of cause.
Nothing in these terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded. If you are a consumer under that law, you are entitled to statutory guarantees that apply alongside these terms.
12. Changes to these terms
We may update these terms. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of BesiaBIM after that date constitutes acceptance. Non-material changes (typos, clarifications) take effect when posted.
13. Governing law
These terms are governed by the laws of South Australia. Both parties agree to attempt to resolve any dispute through good-faith discussion before any formal action.
